Alternative Dispute Resolution

Individuals and organisations, however large, who find themselves in dispute resulting from negligence, broken promises or contract conditions or any other form of damage and then incur costly time -consuming litigation.Attention both within and without the legal profession has increasingly turned to methods of resolution such as Conciliation, Arbitration and Mediation where the integrity of the process depends on the participants rather than a remote and self-contained 'other'. Our Consultants have been accredited and registered by the Centre for Dispute Resolution and are competent to mediate in disputes between parties in any sphere of work in the UK and overseas.One outcome of the recent review of the Civil Justice system in England and Wales has been an increased emphasis on mediation in order to save Court time and associated costs. Judges, when allocating and deciding the correct 'track' for any given claim, have been urged to ask parties whether they have considered an alternative approach. They may decide not to proceed with a case until the parties have attempted such a course of action. This new stage in proceedings has an immediate effect on solicitors who may feel duty-bound to advise their clients to take up this action before a claim is made, rather than be required to at a later stage when considerable expense has already been incurred.Ashley Maynard and Rowan, with experience in both commercial and public agencies, are particularly well placed to mediate in disputes between these two cultures.
